TERMS AND CONDITIONS
AGREEMENT BETWEEN THE CLIENT AND ISLANDS OF LORETO – HELI TOURS

This document establishes the terms and conditions governing the contracting and provision of air transportation services and helicopter tours operated by Islands of Loreto – Heli Tours.
The confirmation of a reservation, the contracting of services, or the use thereof implies the express, full, and unconditional acceptance of these terms and conditions, without exception.

GENERAL CONDITIONS
All services are subject to aircraft availability, crew availability, operational conditions, weather conditions, and aviation safety requirements.
The client and passengers expressly acknowledge that activities related to helicopter flights involve inherent risks associated with aviation, including, but not limited to, changing weather conditions, turbulence, unforeseen technical failures, and any other contingencies inherent to air operations, agreeing to participate voluntarily and at their own risk.
By confirming a reservation, the client declares that they have read, understood, and fully accepted this agreement.

RESERVATIONS AND PAYMENTS
All reservations must be requested at least 48 hours in advance and are subject to availability.
A reservation shall be considered formally confirmed only once full payment has been received or a duly signed service order has been provided.
Unless otherwise agreed in writing, the client must pay 100 percent of the total amount prior to the flight.
Rates are expressed in U.S. Dollars (USD) and may be paid in Mexican Pesos (MXN) at the exchange rate in effect at the time of payment.
Rates include aircraft, pilot, fuel, insurance, and applicable permits. Any additional services, including ground transportation, extended waiting time, or special services, must be previously requested and confirmed in writing and may incur additional charges.

USE OF THE SERVICE AND CLIENT DECLARATIONS
The client declares that they have the legal capacity to contract the service, as well as to accept these terms and conditions on their own behalf or on behalf of the passengers for whom they are legally authorized to act. Furthermore, the client declares under oath that all information provided for the reservation is true, complete, and corresponds fully to their identity at the time of service.
The service must be used exclusively for lawful purposes, and any improper, fraudulent, or unlawful use is strictly prohibited.

CHECK-IN AND DOCUMENTATION
All passengers must check in at least 30 minutes prior to the scheduled departure time. Failure to comply with this requirement may result in the cancellation of the service without refund.
Failure to appear at the scheduled time shall be considered a no-show and will not be eligible for any refund.
The client and passengers are required to present valid official identification upon request. Foreign passengers must carry a valid passport and, when applicable, proper immigration documentation in accordance with applicable regulations. Lack of valid documentation will prevent boarding without any liability for the company.

PASSENGER HEALTH AND PHYSICAL CONDITION
Passengers declare that they are in suitable physical and health condition to participate in the activity and agree to inform in advance of any relevant medical condition that may affect their safety, the safety of other passengers, or the operation itself.
Failure to disclose relevant medical information shall be the sole responsibility of the passenger, understanding that the company makes operational decisions based on the information provided at the time of reservation and prior to the flight.

CANCELLATIONS AND REFUNDS
In the event of adverse weather conditions or factors beyond the company’s control, Islands of Loreto – Heli Tours reserves the right to cancel the operation at any time, including without prior notice, whenever required for operational safety.
Cancellations made by the client more than 24 hours prior to the scheduled departure day will not incur any penalty. Conversely, cancellations made within 24 hours prior to departure, as well as no-shows, will be considered fully non-refundable.
In the event that the service cannot be carried out or rescheduled due to causes beyond the client’s control, including, but not limited to, adverse weather conditions, operational restrictions, or any other external factor that compromises the safety or feasibility of the service, the company may, at its sole discretion, offer rescheduling of the service or the corresponding refund.

GROUND WAITING TIME
Unless otherwise agreed in writing, the helicopter will return to its base immediately after completion of the contracted service.
Any request for ground waiting time must be made at least 24 hours in advance and may incur additional charges. Availability of this service is not guaranteed.

WEIGHT, CAPACITY AND OPERATIONAL SAFETY
For safety and weight balance purposes, all passengers must provide their approximate body weight at the time of booking. Passengers may be weighed upon arrival prior to boarding. If the actual weight exceeds the declared weight or compromises the balance and safety of the
aircraft, boarding may be denied or the service may be rescheduled at the discretion of the pilot in command.
The maximum individual weight limit is 100 kg (220 lb) per passenger. Passengers exceeding this limit may be required to purchase an additional seat for safety and weight distribution purposes.

MINORS
Minors must travel accompanied by a parent or legal guardian, who will assume full responsibility for their safety and conduct.
Minors count as one passenger for all operational purposes. Children under two years of age may travel on an adult’s lap, under the sole responsibility of the accompanying adult.
The adult responsible for the minor declares under oath that they have the legal authority to authorize the minor’s participation in the flight, assuming full responsibility for their safety, conduct, and any situation arising from their participation.
Furthermore, the person authorizing the minor’s participation releases Islands of Loreto – Heli Tours, as well as its employees, pilots, affiliates, and business partners, from any liability related to the minor, except in cases of proven negligence.

BAGGAGE AND GROUND SERVICES
Due to aircraft limitations, baggage capacity is restricted and subject to operational approval. Each passenger is allowed one carry-on item of up to 10 kg (22 lb).
Any excess, oversized, or special baggage must be declared at the time of booking for prior evaluation and approval. Undeclared items may be denied at boarding in order to protect safety and ensure proper aircraft balance.
For Air Shuttle services between Loreto’s private FBO and Hotel Villa del Palmar, ground transportation of luggage from the commercial airport to the hotel, as well as passenger transportation from the commercial airport to the private FBO, may be included at no additional cost when operational conditions require it.
Any additional ground transportation services not expressly included may incur extra charges and are subject to availability and prior confirmation.
All ground services are subject to confirmation based on operational requirements.

OPERATIONAL AND SAFETY CONDITIONS
The pilot in command has full authority to delay, modify, or cancel any service when deemed necessary to ensure operational safety.
Passengers must comply at all times with instructions given by the crew. Failure to comply will result in immediate cancellation of the service without refund.

LIABILITY AND INSURANCE
Operations are covered by insurance in accordance with applicable aviation regulations.
However, the company shall not be responsible for the loss, damage, or misplacement of personal belongings, nor for delays, cancellations, or expenses arising from external factors, including weather, operational, technical, or third-party conditions.
The client and passengers expressly accept that the company shall not be liable for direct, indirect, incidental, or consequential damages arising from the provision of the service.
Furthermore, the client and passengers expressly release Islands of Loreto – Heli Tours, as well as its employees, pilots, affiliates, and business partners, from any liability for damages, injuries, or losses arising from participation in the activity, except in cases of proven negligence.

PROHIBITED ITEMS
The transport of any item that represents a risk to the operation is prohibited, including weapons, explosives, hazardous or illegal substances.
The consumption of alcohol or substances before or during the flight is strictly prohibited, as well as smoking on board or in the vicinity of the aircraft.

FORCE MAJEURE
The company shall not be responsible for cancellations, delays, or modifications resulting from circumstances beyond its control, including weather conditions, technical failures, or governmental restrictions.

USE OF IMAGE
The passenger authorizes the use of photographs or videos taken during the experience for promotional, advertising, commercial, or institutional purposes by Islands of Loreto – Heli Tours, unless otherwise stated in writing prior to the flight.

MODIFICATIONS TO THIS AGREEMENT
Islands of Loreto – Heli Tours reserves the right to modify these terms and conditions at any time. Any use, booking, confirmation, or enjoyment of the service after such modifications shall constitute acceptance thereof.

ACCEPTANCE
By confirming the reservation, contracting the service, boarding the aircraft, or signing the corresponding documents, the client and passenger acknowledge that they have read, understood, and fully accepted these terms and conditions, agreeing to comply with them in their entirety.
